Digital Product License Agreement (EULA)
1. Purpose and intellectual property
These terms govern the use of the digital products offered by Dany Hoang Production (PowerGrades, LUTs, Presets, Notion Templates, VFX, export settings), hereinafter “the Products”. Purchasing a Product grants the buyer a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to use it, under the conditions below. It does not transfer any intellectual property rights. All rights to the Products remain the exclusive property of Dany Hoang Production.
2. Scope of the license
Access to the Product is strictly personal and reserved to the buyer. The buyer may install it on their own workstations and use it in their own projects, personal or professional. The buyer may allow their direct collaborators (partners, employees, contractors) to use the Product, solely as part of joint work with them on the same project and for the duration of that project. These persons may not keep the Product after the project ends, use it for other projects, or pass it on to third parties. The buyer remains responsible for these persons' compliance with these terms. The buyer may deliver final exported renders to their clients (for example, finished videos), but never the source files (LUTs, PowerGrades, Presets, VFX, Templates). Videos graded by the buyer belong to them, with no attribution requirement.
3. Prohibited uses
Except as provided in article 2, it is strictly prohibited to: resell, share, give away, lend, transfer, sublicense or make the Products available, in whole or in part, including in modified form (shared drives, marketplaces, bundles, NFTs, etc.); redistribute the Products as is or in derivative form (for example, creating or reselling derivative LUTs or Presets); incorporate the Products (or their derivatives) into a competing product or a competing resource library; use the Products to train artificial intelligence or machine learning models; provide source files to a client (only exported deliverables are allowed); for Notion Templates, resell them, redistribute them, or publish derivative templates, use being limited to the buyer's internal needs; decompile, reverse-engineer, circumvent protections, carry out mass extraction (scraping), or alter metadata or attribution notices in order to conceal the origin of the files.
4. Delivery
Once payment is confirmed, the Product is delivered immediately by electronic means, either by email to the address provided when ordering, or via the buyer's account on the site. The buyer must check that their email address is correct and check their spam folder.
5. Right of withdrawal
As the Products are digital content supplied without a physical medium, the consumer buyer who requests immediate access to the Product acknowledges, via a separate checkbox before payment, that performance of the contract begins immediately and that they lose their 14-day right of withdrawal, in accordance with article L221-28, 13° of the French Consumer Code. Without this acceptance, payment cannot be completed.
6. Updates
Updates to the Product are free for as long as the Product remains on sale, subject to availability, and without any guarantee of compatibility with all versions, present or future, of third-party software (notably DaVinci Resolve).
7. Term and revocation
These terms apply for as long as the buyer retains the Product. In the event of a serious breach, in particular of articles 2 and 3, Dany Hoang Production may revoke the license as of right, after formal notice has gone unanswered for 8 days. In the event of an irremediable breach (sharing or reselling the files), revocation is immediate. The buyer must then delete all copies and stop all use of the Product. No refund is due in the event of revocation for the buyer's breach, without prejudice to the rights granted to consumers by law.
8. Sanctions
Any breach may result in suspension or termination of access, civil and/or criminal proceedings, and claims for damages.
9. Warranty and liability
Color rendering depends in particular on the camera, color profile, screen and the user's settings. The Products are supplied without any guarantee of an identical result on all hardware. This clause does not limit the legal warranties available to consumers.
10. Personal data
Data collected when ordering is processed in accordance with the Privacy Policy. Payments are processed by Stripe.
11. Governing law
These terms are governed by French law. Consumers residing outside France retain the benefit of the mandatory consumer protection provisions of their country of residence. EU consumers may also consult the dispute resolution resources made available by the European Commission.
